1. Subscription Model

• Evenli operates on a subscription basis.
• Evenli Bridge — £192 per year (covers two linked parents; equivalent to £8 per month per parent). Includes a 10-day free trial.
• Evenli Link — £288 per year (covers up to six family members; for higher conflict or legal oversight). Includes a 10-day free trial.
• An active subscription is required for continued access to Evenli's services.

2. Cancellation and Right to Cancel

• Statutory right to cancel (cooling-off period): If you are a consumer in the United Kingdom, you have a 14-day right to cancel your subscription and receive a full refund under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This period begins on the date your subscription is activated. To exercise this right, email info@evenli.co.uk within 14 days of purchase.
• Waiver of cooling-off right: If, at the point of subscribing, you expressly request that your subscription starts immediately and you begin using Evenli's paid features during the 14-day cooling-off period, you acknowledge that you waive your right to a full refund from the point you first access paid features. You will be asked to confirm this at checkout.
• 28 days' notice is required to cancel a subscription outside the cooling-off period. You will retain access until the end of your current billing period.
• Access remains active until the end of your current billing period.
• No partial refunds are offered for unused portions of a billing cycle, except as required by applicable law.
• Split-pay activation refund (Evenli Bridge only): When you choose to split the Bridge subscription £96 each, your co-parent has 5 days from your payment to pay their share. If they do not pay within that window, your £96 share is fully refunded automatically and no subscription is created. Once both shares are paid, the standard 28-day cancellation policy above applies for the remainder of the subscription term.
• Professional sponsorships: Activation codes purchased by a sponsoring professional are non-refundable once issued, but unredeemed codes expire 60 days after purchase. A redeemed code grants 12 months of access to the redeeming family.

3. The Service

• Evenli is a web application accessed through any modern browser.
• It can be installed to the home screen on iPhone (Safari) or Android (Chrome) as a Progressive Web App.
• Service availability depends on your internet connection and standard hosting infrastructure.

4. Use of AI

• Evenli uses OpenAI's GPT-4o mini to process messages for conflict scoring and tone refinement.
• AI responses are automated and may occasionally be imperfect.
• Users are responsible for verifying event details and important information.

5. Limitation of Liability

Evenli is provided strictly as a coordination and communication tool. Evenli makes no guarantees regarding:

• Message delivery timing
• Continuous service availability
• Accuracy of AI-generated outputs
• Prevention of missed events

Evenli shall not be liable for:

• Missed events
• Misinterpretation of AI outputs
• Internet failures
• Device malfunctions
• User error or incorrect data input
• Third-party platform failures (including OpenAI, Stripe or our hosting providers)

The service is provided "as is" without warranty of any kind.

6. Indemnification

Users agree to indemnify and hold harmless Evenli, its directors, employees, and affiliates from any claims, damages, losses, liabilities, or legal expenses arising from:

• Misuse of the service
• Unlawful or abusive content
• Breach of these Terms

7. Acceptable Use

Users may not:

• Use Evenli for unlawful purposes
• Harass or abuse other users
• Attempt to reverse engineer the service
• Attempt to disrupt or overload the system
• Use automation or bots to spam the service

Evenli reserves the right to suspend or terminate accounts without notice for misuse.

9. Service Modification

Evenli reserves the right to modify:

• Features
• Pricing
• Usage limits
• AI models
• Platform integrations

We will give at least 30 days' notice of any material changes to these Terms, pricing or usage limits. Notice will be provided by email to your registered address and/or by a prominent notice within the platform. If you do not accept the changes, you may cancel your subscription before they take effect, in which case no additional charges will apply for the period after cancellation.

Continued use of Evenli after the effective date of any notified changes constitutes your acceptance of those changes.

10. User Responsibility for Communications

You are solely responsible for everything you choose to send or store through Evenli, including:

• Messages you send
• Attachments you share
• Calendar entries you create
• Expense entries you record
• Notes or records you store
• Any other content you transmit through the platform

Evenli provides AI-assisted message refinement only. AI suggestions are optional. You must actively choose to send a message, and you retain full legal responsibility for the final content sent.

Evenli is not liable for:

• The content of your communications
• Legal consequences arising from messages you send
• Misuse of AI suggestions
• How any court or third party interprets your communications

"AI-generated or AI-assisted content remains the sole responsibility of the user who chooses to send it."

11. AI Assistance Disclaimer

Evenli's AI tools are designed to:

• Reduce aggressive tone
• Remove swearing or inflammatory language
• Reduce conflict-escalating phrasing
• Promote neutral, clear communication

The AI does not:

• Provide legal advice
• Provide psychological advice
• Determine factual accuracy
• Take sides between users
• Make decisions on behalf of users

AI output is generated probabilistically and is:

• Not guaranteed to be accurate
• Not guaranteed to be legally appropriate
• Subject to your review before sending

You must review and approve all content before sending.

12. Platform Neutrality

Evenli operates as a neutral communication platform. It does not:

• Mediate disputes between users
• Judge user conduct
• Score or publicly rank behaviour
• Provide bias toward either parent

The AI is built around the following design principles:

• Neutral tone enforcement
• Removal of profanity
• Removal of aggressive phrasing
• De-escalation bias
• Structured clarity over emotional language

"The AI is designed to reduce hostility and conflict-escalating language. It is not designed to favour either party."

13. Limitation of Liability — AI Systems

Evenli makes no guarantee that any AI-generated or AI-refined output will be suitable for legal proceedings, regulatory submissions or any other formal use.

Evenli is not responsible for:

• Legal disputes arising from your communications
• Emotional outcomes of conversations conducted through the platform
• Any reliance you place on AI phrasing or suggestions

Liability for AI systems is limited consistent with the overall liability cap set out in section 5 above.

14. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) are governed by and shall be construed in accordance with the law of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms. If you are a consumer, nothing in this clause affects your right to bring proceedings in the courts of the country in which you are domiciled.
